This agreement (“Agreement”) between you and Virgin Galactic, LLC (“Virgin Galactic”) sets out the terms and conditions to submit an application to join a spaceflight expedition (the “Application”).
Application and Consultation. Submitting the Application is the first step in being considered for a Virgin Galactic spaceflight expedition. By submitting the Application, you are expressing interest in reserving a spaceflight ticket, but you are not committing to purchase a ticket and no purchase rights are guaranteed. As part of the Application process, you may be invited to consult with Virgin Galactic’s Astronaut Office to learn more about the spaceflight experience and assess readiness. Virgin Galactic will review applications and may invite selected applicants to proceed to the next step, which includes joining the community of Virgin Galactic Astronauts (the “Community”). An invitation to proceed or a consultation is not guaranteed and may depend on availability, safety and other considerations.
Application Fee and Payment Authorization. You agree to pay a one-time application fee of $1,000.00 USD (the “Fee”), and you authorize Virgin Galactic to use a third party, Stripe, Inc., to process the charge of the Fee on your credit card, debit card, reloadable pre-paid card, or other payment method you designate. If you decide to join the Community, the Application Fee will be applied to that purchase. If you decide to withdraw your Application or terminate this Agreement before joining the Community, the Fee will be refunded to you in full. Refunds will be issued to the original form of payment, or as otherwise directed by you, within sixty (60) days of your request. Virgin Galactic is not responsible for any additional fees charged by your payment provider in connection with the refund.
Term. The Application will be effective from the date you sign or electronically accept this Agreement, until the later of (a) twelve (12) months after you accept, or (b) when you sign the written agreement to join the Community, unless you or Virgin Galactic terminates this Agreement earlier.
Personal Information: You consent to Virgin Galactic’s accessing, collecting and using your personal information in accordance with the Privacy Policy, accessible at https://www.virgingalactic.com/privacy-policy. You further consent to Virgin Galactic performing one or more background checks to determine your eligibility to join the Community.
Termination by Virgin Galactic. Your Application may be declined by Virgin Galactic for any reason, including if you breach any provision of this Agreement, violate the policies of Virgin Galactic, engage in improper behavior at Virgin Galactic facilities or events and/or attempt to use your participation in Virgin Galactic programs for commercial purposes. If your Application is declined, this Agreement will be terminated and your Application Fee will be refunded to you in full.
Termination by You. You may withdraw your Application at any time by submitting a request to membership@virgingalactic.com. If you withdraw your Application, this Agreement will be terminated and your Application Fee will be refunded to you in full.
Miscellaneous. You agree that: (a) you consent to enter into this Agreement electronically, to authorize electronic payment processing, and to receive copies of documents and all confirmations, notices, and receipts provided to you under this Agreement; (b) your rights and obligations contained herein cannot be assigned, transferred, delegated or otherwise granted to another person or entity without the prior written permission of Virgin Galactic, but Virgin Galactic may transfer this Agreement at any time; (c) Virgin Galactic may delay or waive enforcement of any of the provisions of this Agreement, without losing its right to enforce the same or any other provision later; (d) this Agreement contains all the agreements between the parties with respect to the subject matter of this Agreement; (e) should any term in this Agreement be deemed invalid or unenforceable, the remaining terms shall remain in full force and effect; and (f) any legal notice or other notice or information as required by law shall be delivered to Virgin Galactic to membership@virgingalactic.com and to you at the email address provided by you at the time of signing (or as otherwise notified).
You agree not to make any news release, advertisement, social media post or other disclosure that relates to this Agreement. You agree not to take any photographs, video or audio recordings of any Virgin Galactic events or facilities except where explicitly designated by Virgin Galactic as media opportunities. In addition, you agree not to use Virgin Galactic’s name, logo or trademarks without Virgin Galactic’s prior written permission.
This Agreement is governed by, and construed in accordance with, the laws of the State of California, without giving effect to the conflict of law provisions if such principles or rules would require or permit the application of the laws of any jurisdiction other than those of the State of California. You further agree that any action, litigation or proceeding of any kind against the other party arising from or relating to this Agreement shall be brought in the state or federal courts of Orange County, California.
By accepting this Agreement, you acknowledge that you are at least 18 years old. You acknowledge and agree that you have received, read, understand and agree to be bound by all the terms and conditions set forth in this Agreement, and that all such terms were disclosed to you prior to signing.
